1. Client work and agreements
These Terms cover your use of this website only. When we work together, the specifics, including scope, deliverables, timelines, fees, payment terms, ownership of work and confidentiality, are set out in a separate proposal, scope of work or services agreement that we both sign. If anything in that agreement conflicts with these Terms, the signed agreement wins.
Nothing on this site is a binding offer. Service descriptions, starting prices and timelines are general information. Your actual scope and pricing will be confirmed in writing before any work begins.
2. Using our site
You're welcome to browse, read, share and get in touch. We just ask that you don't:
- Break the law: use the site for anything unlawful, fraudulent or harmful.
- Interfere with it: try to hack, overload, disrupt or gain unauthorized access to the site or its systems.
- Scrape or copy it: use bots, scrapers or automated tools to collect content or data from the site, including to train AI models, without our written permission.
- Misuse our forms: send spam, malicious links or files, or pretend to be someone you're not.
We may limit or block access to anyone who misuses the site.
3. Our content and brand
Everything on this site, including our copy, articles, case studies, graphics, design, the Akoya Creative name and logo, is owned by Akoya or used with permission, and is protected by copyright and trademark law.
- What's fine: sharing links to our pages, and quoting short passages with clear credit to Akoya Creative and a link back.
- What needs permission: copying, republishing, selling or adapting our content, or using our name or logo in a way that suggests we endorse you.
Client names, logos, images and results shown in our case studies belong to those clients and appear with their permission. Please don't reuse them.
4. Information, not a guarantee
We share what we know through our blog, guides and case studies because we think good information helps businesses make better marketing decisions. That content is general information, not advice for your specific situation, and it isn't legal, financial or tax advice.
Our case studies describe real results for specific clients over specific time periods. Every business, budget and market is different, so those results aren't a promise of what you'll see. We never guarantee search rankings, traffic, AI search visibility, ad performance, leads or revenue, because no honest marketer can. Platforms like Google, Meta and Klaviyo also change often, so some information may become out of date.
5. What you send us
When you contact us through a form, email or scheduling link, you agree that the information you provide is accurate and that you have the right to share it. We handle it as described in our Privacy Policy.
Please don't send passwords, login credentials or highly sensitive information through our contact form. If we start working together, we'll set up access securely during onboarding.
If you send us ideas, feedback or suggestions about our services or site, we may use them without any obligation to you. Confidential project information shared after we've signed an agreement is covered by that agreement instead.
6. Third-party links and tools
Our site may link to or use other services, such as Calendly for scheduling, LinkedIn, client websites and articles we reference. We don't control those sites and aren't responsible for their content, policies or practices. Your use of them is governed by their own terms.
7. Disclaimer
We work hard to keep this site accurate and running smoothly, but we provide it "as is" and "as available." To the fullest extent the law allows, Akoya makes no warranties of any kind, express or implied, about the site or its content, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don't promise the site will always be available, error-free or free of viruses.
8. Limitation of liability
To the fullest extent the law allows, Akoya and its owners, team members and contractors won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, revenue, data or business opportunities, arising from your use of, or inability to use, this website or its content. If we are found liable for anything related to the website, our total liability will not exceed one hundred U.S. dollars ($100).
Some places don't allow certain limitations of liability, so parts of this section may not apply to you. This section covers the website only. Liability for client services is set out in our signed agreements.
9. Indemnification
If you misuse this site or break these Terms and someone makes a claim against Akoya because of it, you agree to cover the reasonable costs and damages that result, including reasonable attorneys' fees.
10. Governing law
These Terms are governed by the laws of the State of Maine, without regard to conflict of law rules. Any dispute about this website will be handled in the state or federal courts located in Maine, and you agree to the jurisdiction of those courts. Before anything goes that far, we'd much rather talk it through, so please reach out to us first.
11. Changes and other terms
- Updates: we may update these Terms from time to time. The "Last updated" date at the top shows when. Continuing to use the site after a change means you accept the updated Terms.
- Severability: if any part of these Terms is found unenforceable, the rest still applies.
- No waiver: if we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later.
- Whole agreement: these Terms and our Privacy Policy are the full agreement between you and Akoya about use of this website.
